Bollywood superstar Salman Khan has withdrawn his insolvency petition against equipment manufacturer Jerai Fitness Pvt Ltd after the two parties reached a settlement over a ₹7.24 crore payment dispute. The dispute was related to Khan’s fitness equipment brand, Being Strong.
The settlement was confirmed before the National Company Law Appellate Tribunal (NCLAT) on Wednesday, with Justice Ashok Bhushan presiding over the matter.
### Background of the Dispute
The dispute originated from a trade license agreement signed in October 2018 between Salman Khan’s Being Strong and Jerai Fitness. This agreement allowed Jerai Fitness to use the “Being Strong” trademark on its manufactured fitness products.
However, due to business disruptions caused by the COVID-19 pandemic, Khan revised the royalty payments due to Jerai Fitness’s request, extending the revised terms until March 31, 2023. Subsequently, after Jerai allegedly failed to make the payments, Khan issued a demand notice on September 14, 2024.
### Jerai Fitness’s Counterclaim
Jerai Fitness countered Khan’s claim by asserting that a pre-existing dispute existed between the parties. The company stated it had invested heavily in developing components for new product lines such as the “X-tend” series and “Proton” series.
According to Jerai, there were several operational challenges originating from Being Strong’s side.
### NCLAT’s Earlier Verdict
In May, the Mumbai bench of NCLAT dismissed Salman Khan’s insolvency plea against Jerai Fitness. The tribunal ruled that Jerai had the right to manufacture and sell products under the “Being Strong” trademark.
NCLAT observed that Jerai Fitness was authorized to “manufacture, market, distribute, and sell” products using the “Being Strong” trademark, including creating promotional material. However, the tribunal emphasized that all major decisions regarding product manufacturing, promotion, marketing, and distribution required pre-approval from Salman Khan or his authorized representative, Alvira Agnihotri.
The tribunal also noted that the claims were disputed and fell within the realm of recovery proceedings, prompting Khan to challenge the dismissal.
### Conclusion
With the recent settlement, Salman Khan has withdrawn his insolvency plea, bringing an end to the ongoing legal tussle with Jerai Fitness. This resolution paves the way for smoother operations for the Being Strong brand and its manufacturing partners moving forward.
